May 3, 2024 The Honorable Kristen Clarke Assistant Attorney General of the United States U.S. Department of Justice 950 Pennsylvania Avenue, NW Washington, D.C. 20530-0001 Dear Associate Attorney General Clarke: A bombshell investigation by journalist Mary Margaret Olohan of the Daily Signal casts significant doubt on the truthfulness of your testimony at your confirmation hearing. At your hearing, Senator Tom Cotton asked whether you have “ever been arrested or accused of committing a violent crime against another person?” At that time, you stated “No.” This was a simple question about facts for you, Ms.

Clarke; it was a question of whether the event happened or not—not whether the matter had subsequently been expunged by the courts. However, Olohan’s investigation discovered authenticated text messages and records that appear to contradict your statement. According to the authenticated text messages and records, a criminal case was initiated against you regarding a situation in which your ex-husband Reginald Avery alleged that you “attacked him with a knife, deeply slicing his finger to the bone, on the night of July 4, 2006” in the District Court of Maryland for Prince George’s County.

Olohan also found that you later pursued an “Order for Expungement of Police and Court Records.” Further, following the release of Olohan’s investigation, you confirmed to CNN that you did not disclose your expungement. In the event that you have not yet reviewed the findings of Olohan’s investigation, we have attached a copy of the report for your convenience. The American people deserve a Civil Rights Division at the U.S. Department of Justice led with honesty and integrity.

Since taking over the Civil Rights Division, you have weaponized the Department of Justice by wielding the FACE Act against pro-life Americans in an unprecedented manner—even while standing idly by as churches and pro-life pregnancy centers are vandalized, and Jewish students are unable to attend class on college campuses. The American people have lost trust in your ability to lead the Civil Rights Division. We request that you resign immediately.
