The Advancing American Freedom Foundation is releasing a new Legal Report from its Edwin Meese III Institute for the Rule of Law urging the Supreme Court and Congress to restore freedom of speech and association for political parties and their members by overriding the limits on coordinated expenditures.
The new report, “Coordination Limits on Political Parties Violate the Constitution – National Republican Senatorial Committee v. Federal Election Commission,” is authored by Hans von Spakovsky, who served as a commissioner on the FEC and is now a Senior Legal Fellow at Advancing American Freedom.
Marc Wheat, General Counsel for Advancing American Freedom, said:
“Advancing American Freedom filed an amicus brief with the Supreme Court in this case on behalf of itself and many other organizations because freedom of speech and activity in the political arena is not only protected by the First Amendment, but is pivotal to representative government and maintaining a democratic Republic.”
Hans von Spakovsky, the author of the Legal Report, added:
“It was Alexis de Tocqueville himself who recognized the importance of associational rights in maintaining the liberty and freedom that Americans hold so dear; the federal law limiting the ability of political parties to support the candidates they recruit to represent their members is not only unconstitutional but interferes in the very purpose of political associations.”
