AAF Fights for a Return to Constitutional Order in the Executive Branch

Advancing American Freedom led a coalition of 32 other amici fighting to restore the Founding Fathers’ vision of the Executive Branch of the federal government as codified in Article II of the U.S. Constitution. In its amicus brief in American Securities Association v. SEC, AAF argued that the Constitution intentionally vests the executive power of the United States in the President, not in an unelected and unaccountable administrative state. It is time for the courts to reverse the decades-long bureaucratic takeover of American government.

 

“The Founders knew the importance of separating government power to protect the liberty of the people, but they also knew that the important work of executing laws passed by Congress could not be carried out effectively by a committee,” said AAF General Counsel J. Marc Wheat. “The Eleventh Circuit should allow this case to proceed and should find that the protections that prevent the President from exercising meaningful control over the Securities and Exchange Commission are unconstitutional.”
