Advancing American Freedom led a coalition of 37 other amici fighting big brother. In Texas Top Cop Shop v. Garland, Texas Top Cop Shop is challenging the Corporate Transparency Act (CTA) that requires corporations, from small businesses to political organizations, to report “Beneficial Owner Information” to the government. The CTA is unconstitutional because it is not an exercise of any of Congress’s enumerated powers. AAF calls on the Supreme Court to reinstate the stay issued by the district court so that Americans’ information will be protected while this unconstitutional law is litigated.
“The Constitution grants only limited powers to Congress, none of which justify the CTA” said AAF General Counsel J. Marc Wheat. “The government cannot violate the rights of the people merely because doing so is convenient for the enforcement of some laws. The CTA’s enforcement should be stayed until the courts have time to consider it fully.”
