Today, the Fourth Circuit Court of Appeals upheld West Virginia’s law outlawing most abortions. After the Supreme Court’s historic 2022 decision in Dobbs v. Jackson Women’s Health Center overturning Roe v. Wade, West Virginia enacted a law banning most abortions. In response, the manufacturer of the dangerous abortion drug mifepristone sued the state, claiming that because the federal Food and Drug Administration had approved mifepristone, states are not allowed to ban its use for abortions. The Fourth Circuit rightly ruled for West Virginia’s pro-life law, affirming the lower court’s decision.
“The FDA’s initial approval in 2000 and subsequent regulation of the dangerous abortion drug mifepristone was and remains the product of pro-abortion politics, not science,” said AAF General Counsel J. Marc Wheat. “We applaud the efforts of states like West Virginia to protect women and the unborn from the deadly consequences of chemical abortion and we applaud the Fourth Circuit’s decision upholding West Virginia’s law. This is a great win for life and for the states fighting to protect it.”
