The Biden Department of Homeland Security issued a new “Fair and Humane Public Charge Rule,” which the criteria for public charge determinations. Under the new rule, the DHS will no longer consider SNAP, CHIP, Medicaid, or other non-cash benefits that a noncitizen is receiving while making its public charge determinations. Furthermore, the DHS will also no longer consider benefits received by the family members of applicants. These changes by the Biden-Harris DHS makes it easier for illegal aliens to rely on public benefits, ensuring that the only things that will trigger a public charge finding are the reception of cash benefits or long-term institutional care.
