AAF Fights Unconstitutional Tariffs in the DC Circuit

Advancing American Freedom, joined by 11 other amici, filed an amicus brief inĀ Learning Resources, Inc. v. Trump, a case currently before the D.C. Circuit challenging the President’s assertion of unilateral tariff authority. Article I, Section 8 of the Constitution explicitly and exclusively vests the federal government’s taxing power in Congress and Congress is not empowered to delegate its legislative powers to any other entity. For decades, the courts and Congress have enabled the Executive Branch to take vast power for itself. AAF urges the D.C. Circuit to rule for the American small businesses who brought this suit and uphold the Constitution’s structure.

“The Framers of our Constitution understood that the separation of the government’s powers was an essential bulwark of liberty,” said AAF General Counsel J. Marc Wheat. “By ruling for the small businesses challenging the President’s tariffs, the D.C. Circuit can uphold the governmental structure that keeps us free and can return the taxing power to the people’s representatives in Congress where it belongs.”
